Prescription Fraud Under Oklahoma Law

Oklahoma’s prescription fraud statute, 63 O.S. Section 2-407, covers a broad range of conduct. Under that law, it is a crime to obtain or attempt to obtain a controlled dangerous substance through fraud, deceit, misrepresentation, or subterfuge. The statute also prohibits forging, altering, or adding unauthorized information to a prescription or written order.

The law goes further. Knowingly failing to disclose that you’ve already received a controlled dangerous substance or a prescription for one from another practitioner within a defined recent period is itself a violation: the conduct commonly referred to as “doctor shopping.” Critically, an attempt alone is enough for prosecution, even if you never actually received the substance. The physician-patient communication privilege also doesn’t apply to communications made in an effort to unlawfully obtain a controlled substance, which can affect what evidence the state may use.

These charges often rely on records from Oklahoma’s Prescription Monitoring Program, a state database administered through the Oklahoma Bureau of Narcotics and Dangerous Drugs Control that tracks controlled substance prescriptions across providers. Prosecutors use that data to establish prescription histories and allege patterns consistent with diversion or fraud.

Felony Penalties & Consequences in Oklahoma

Prescription fraud is classified as a Class C2 felony under the Uniform Controlled Dangerous Substances Act. 

Sentencing follows 21 O.S. Section 20M and escalates with prior convictions:

• First offense: Up to seven years in prison and a fine of up to $10,000
• One or two prior qualifying felonies: Two to ten years in prison
• Three or More Prior Qualifying Felonies: Two to twelve years in prison and a fine of up to $20,000

A second or subsequent conviction isn’t eligible for a suspended sentence, deferred sentence, or probation. Every conviction also carries a $100 trauma-care special assessment fee. Beyond the criminal penalties, a felony controlled substance conviction in Oklahoma can trigger a separate driver’s license suspension commonly ranging from six months to three years.
