Certificate Action for Motor Vehicle Offenses Under Federal Aviation Regulation 61.15

The FAA can take administrative action against your pilot certificate based on a motor vehicle action, including a DUI/DWI arrest or conviction. This is a federal process that runs entirely parallel to your state criminal case, and it can move quickly.

The 60-Day Mandatory Reporting Rule 

This is one of the most critical requirements pilots face. Federal law requires you to report any “motor vehicle action” to the FAA's Security and Hazardous Materials Safety Office, Regulatory Investigations Division, within 60 days. 

A “motor vehicle action” includes:

  • A conviction of DUI/DWI 
  • A driver's license suspension for failing/refusing a breath or blood test

Failing to deliver a report within the 60-day window is a violation, one that can result in the revocation of your pilot certificate.

Medical Certification Standards 

The FAA's Office of Aerospace Medicine evaluates any alcohol-related event to determine whether it indicates substance abuse or dependence under FAR Part 67. A conviction on your record can trigger a deferral of your medical application, forcing you through a review process that’s time-consuming and expensive.
