Brian K. Morton - The Drivers License Attorney

Driver’s License attorney, Brian Morton is a 2000 graduate of the University of Oklahoma College of Law. Mr. Morton joined Hunsucker Legal Group from the Oklahoma Department of Public Safety (DPS). At DPS, Mr. Morton was a hearing officers and represented the Department in District Court on driver’s license revocation and motor carrier safety matters. Prior ro DPS, Mr. Morton served as an Assistant District Attorney in Sequoyah County, Oklahoma and also practiced as a criminal defense attorney.

In July 2014, Mr. Morton left DPS and now handles all driver’s license matters for the Hunsucker Legal Group. Mr. Morton is a member of the Oklahoma Criminal Defense Lawyers Association; a member of the National College of DUI Defense where he was the Oklahoma State delegate for a number of years, and he served as a Governor-at-Large for the Oklahoma Bar Association Board of Governors from 2018-2020. Additionally, Mr. Morton is a veteran of the United States Coast Guard.

During his 10 plus years with the Hunsucker Legal Group, Mr. Morton has been instrumental in a number of Oklahoma Appellate Court cases which significantly impacted the area of driver’s license law. In the case of Sample v. DPS, Mr. Morton challenged the breath testing rules of the Oklahoma Board of Tests which resulted in thousands of driver’s license revocations across the state being set aside by DPS. In Shoptaw v. DPS, he argued that a supplemental affidavit used by DPS was insufficient to revoke a driver’s license. The Courts agreed and again, thousands of driver’s licenses revocation were thrown out by DPS. In the case of Hunsucker v. Fallin, Mr. Morton represented Hunsucker Legal Group as lead plaintiff in a rare oral argument before the Oklahoma Supreme Court challenging the Constitutionality of a new law. The Oklahoma Supreme Court found that the new law violated Oklahoma’s single subject requirement and determined the new law indeed violated the Oklahoma Constitution. The law never went into effect.

Based on his work in the Hunsucker v. Fallin case, Mr. Morton was presented with the Justice Thurgood Marshall Award by the Oklahoma Criminal Defense Lawyers Association (OCDLA). Additionally, he was nationally recognized by the National College for DUI Defense where he was awarded the Appellate Advocacy Award during their Summer Session at Harvard University.

Mr. Morton has also seen much success in the District Courts as well. A law called the Erin Sweezey Act required additional interlock instillation after a person had completed their revocation period. This law was rescinded in 2019, however DPS was still making drivers comply with the old law if they were revoked prior to the law change. Mr. Morton successfully argued before the District Courts that DPS could no longer enforce the old law, and the District Courts agreed. Rather than appeal to the Oklahoma Supreme Court, DPS caved and took the additional interlock requirement off every affected driving record.

Mr. Morton continues to sharpen his skills by regularly attending training in the area of DUI law, and he has attended the same Standardized Field Sobriety Test (SFST) training that police officers go through. Mr. Morton is often called upon by the State and local county bar associations across the state to present training on driver’s license law. He has presented numerous times at the OCDLA Summer Criminal Defense Institute and Cindy Foley Criminal Defense Basics providing training and legal updates on driver’s license law. He has even been requested by the state Judiciary to provide training to District Court Judges at their Summer conference. In short, Mr. Morton is the attorney other attorneys call when they have a driver’s license question.
