This treatment program offers qualifying individuals a chance to get help with alcohol and substance abuse problems and is an alternative to jail time.  Depending on the county, successful completion can make the charge go away completely.

Who Qualifies for the Program?

Only those facing felony DUI or APC charges qualify for the program. Depending on the county, some will not be eligible unless it is their second or third DUI/APC felony charge, while a few counties will admit first-time felony DUI offenders.

You may not qualify for the program if you have certain prior charges on your criminal record, including:

  • Any violent felony crime
  • Drug trafficking or manufacturing
  • Offenses involving firearms
  • Personal injury crimes such as child abuse, elder fraud, or hate crimes

How Does the Program Work?

Program participants are required to attend several group counseling or therapy sessions per week as well as make one court appearance a week for a review by the judge. Participants must also attend individual counseling sessions and submit to random drug and alcohol tests. The program typically takes about 18-24 months to complete.

Upon successful completion, the charge is dismissed or the participant is placed on probation to see if they can make a successful transition out of the program. If a participant relapses, he or she may be granted more time in the program; however, it is up to the discretion of the judge, and participants only have so many chances before they are sent to prison for failure to comply.
