First Degree Manslaughter
If you are arrested for a misdemeanor DUI or DWI and a death results during the commission of the DUI or DWI, then you can be charged with First Degree Manslaughter. This can be confusing as people will refer to it as Misdemeanor Manslaughter which simply means it is a Felony Manslaughter charge because a death occurred in the commission of a misdemeanor (DUI/DWI). The correct charge in Manslaughter in the First Degree and is always a felony charge. The penalty for Manslaughter 1st Degree is a minimum of four years up to life in prison.
Second Degree Murder
If you are arrested for a felony DUI or any other felony and a death results during the commission of that felony, you can be charged with Second Degree Murder or Murder 2nd Degree. A conviction means a minimum of ten years and up to life in a state penitentiary.
