Common Sex Crimes We Defend Against
Sex crimes are taken very seriously in Oklahoma and carry harsh penalties if convicted. Regardless of the type or severity of the charges against you, consulting a trusted sex crime defense lawyer is paramount to safeguarding your freedom and future.
Common sex crimes we defend against include:
Sexual Assault
Sexual assault is any type of sexual contact or behavior that occurs without explicit consent of the recipient, including (but not limited to) forced sexual intercourse, forcible sodomy, child molestation, child sexual abuse, incest, fondling, and all attempts to complete any of the aforementioned acts (21 O.S. § 112).
College Campus Sex Crimes
College campus sex crimes often involve allegations of assault, harassment, or inappropriate relationships among students or faculty. Convictions can lead to expulsion, jail time, and mandatory sex offender registration. Our attorneys have a deep understanding of these cases to help you protect your education and reputation.
Internet & Computer Sex Crimes
Our firm has extensive experience defending against all types of internet and computer sex crimes. Common offenses we defend against include internet prostitution, online solicitation of a minor (§ 21-1040.13a), nonconsensual dissemination of private sexual images (§ 21-1040.13b), and the purchase, procurement, or possession of child pornography (§ 21-1024.2).
Child Prostitution & Sex Trafficking
Child prostitution and sex trafficking are serious offenses under state and federal law. These charges often involve complex investigations and harsh penalties upon conviction. Our firm has a reputation for successfully defending against these allegations and helping clients avoid severe consequences.
Rape
While rape falls under the umbrella of sexual assault, it has a distinct definition under state law. This offense is defined as nonconsensual sexual intercourse involving vaginal or anal penetration of an individual who isn't the spouse of the perpetrator (21 O.S. § 1111). This applies regardless of sex or sexual orientation.
Statutory Rape
Statutory rape refers to sexual intercourse with a person who is legally unable to consent. This includes minors under the age of 16 and individuals incapable of consenting due to a physical or mental incapacity (temporary or permanent). Consulting an experienced defense attorney is critical to avoiding a felony conviction.
What Are the Penalties for a Sex Crime Conviction?
While the penalties for a sex crime conviction depend on the specific offense, sex crimes are often punishable by significant fines and lengthy prison sentences. The penalties can range from 15 years in prison for first-time offenders to life in prison without parole for aggravated offenses.
In addition to these penalties, individuals convicted of certain sex offenses may also be required to attend counseling or treatment programs, undergo regular monitoring by law enforcement, and face restrictions on where they can live, work, and travel due to mandatory sex offender registration.
What Is the Age of Consent in Oklahoma?
In Oklahoma, the age of consent is 16 years old. This is the minimum legal age at which an individual can consent to sexual intercourse with another individual, meaning that minors who are 15 years old or younger cannot legally consent to sex with an adult who is at least 18 years old. However, there are a couple of exceptions to this rule, including:
- Marital exception. This permits lawful, consensual sex between minors and adults who are legally married.
- Romeo and Juliet law. Also known as a close-in-age exemption, Oklahoma’s Romeo and Juliet law permits consensual sex between minors who are close in age and between the ages of 14 and 18.
What Constitutes Consent?
Consent is defined as “the affirmative, unambiguous and voluntary agreement to engage in a specific sexual activity during a sexual encounter which can be revoked at any time” (21 O.S. § 113). It cannot be given when 1.) an individual who is asleep, mentally or physically incapacitated, or under duress, threat, coercion, or force; and 2.) cannot be inferred under circumstances in which consent is unclear, including the absence of a verbal response and the existence of a prior or current relationship.
When Is Sex Offender Registration Mandatory?
Sex offender registration is mandatory for any person who has been convicted of a crime requiring them to register pursuant to the terms of Oklahoma’s Sex Offenders Registration Act, including (but not limited to) rape, sexual battery, and sex crimes against minors.
The registration requirement applies regardless of whether the offense results in incarceration, probation, or a suspended sentence. Its duration depends on which “level” is assigned, including 15 years for level one offenders, 25 years for level two offenders, and lifelong registration for level three offenders.
Sex offender registration can have lasting consequences on employment, housing, and social relationships, making it crucial to secure legal representation as soon as possible. If you’re facing sex crime charges, our lawyer can aggressively protect your rights and help you defend against the life-altering consequences of a sex crime conviction.
Legal Defenses Against Sex Crimes
If you’re facing sex crime allegations, seeking sound counsel is critical to defending your rights. Some common legal defenses against sex crimes include:
- Proving consent. Often, the prosecution must prove a lack of consent to secure a conviction. If the alleged victim voluntarily consented to the sexual activity, we can fight to dismiss the charges against you.
- False allegations. If the alleged victim made false accusations due to a misunderstanding or ulterior motives, our firm can investigate the facts and question witnesses to uncover any inconsistencies in the accuser’s story.
- Alibi. If you weren’t present at the time or location where the crime occurred, we can help you gather surveillance footage, witness testimonies, and other evidence to establish a credible alibi and prove your innocence.
- Insufficient evidence. The prosecution must prove your guilt “beyond a reasonable doubt” to convict you. Our firm can challenge weak or inadmissible evidence to drop or reduce the charges you’re facing.
- Constitutional violations. If law enforcement violated your rights during the investigation, such as conducting illegal searches or seizures, this can be grounds for dismissal. We can work diligently to flag potential violations and protect your constitutional rights.
