In Oklahoma, you can be charged with an attempt to kill if you commit a violent act or use deadly force against another person, even if the act does not result in death. Title 21, § 651-652 of the Oklahoma statutes outlines several distinct charges related to intent to kill, including:

  • Attempt to kill by poison
  • Shooting or discharging a firearm with intent to kill
  • Assault and battery with a deadly weapon
  • 653 provides a penalty for any other assault that is intended to kill and that is not covered under the other assault and battery statutes.

Potential Penalties for Attempts to Kill

  • An attempt to kill by poison is considered a felony and is punishable by a minimum 10 years in prison.
  • Shooting or otherwise discharging a firearm at another person with intent to kill is a felony crime, punishable by up to life in prison.
  • Any other assault that is intended to kill and is not covered in another statute is a felony that may be punished by up to five years in prison.
