What Constitutes Trafficking?
In order to convict you of marijuana trafficking, the prosecution will have to prove certain elements. These elements include knowingly:
- Distributing marijuana
- Bringing marijuana into the state
- Possessing specified amounts of marijuana
In Oklahoma, the specified amount of marijuana to constitute trafficking is 25 pounds.
Penalties for Marijuana Trafficking
If found guilty of trafficking marijuana in the amount of 25 to 999 pounds, you could face the following:
- Minimum four years imprisonment
- Fine between $25,000 and $100,000
However, if you are caught with 1,000 pounds or more, you could face a charge of aggravated trafficking, which could result in:
- Mandatory minimum fifteen years in prison
- Fine between $100,000 and $500,000
