Possession of marijuana is considered a misdemeanor offense, even if you have a prior criminal record or have been arrested for drug possession in the past. The penalties for conviction can include a fine of up to $1,000 and no more than one year in jail.
Does the Amount of Marijuana Matter?
The penalties outlined above apply to any amount of marijuana up to an ounce. In Oklahoma, having even as little as a joint, roach, or pipe containing marijuana residue can lead to a possession charge. However, if you are found with an ounce of pot or more, you could be looking at a possession with intent to distribute charge, which increases the potential penalties substantially. This is especially true is the marijuana is bagged in different containers or the police find scales or other evidence of intent to distribute.
