Penalties for Marijuana Cultivation
If you are found growing marijuana on your land, you can be charged with a felony offense and face the following penalties:
- Up to $50,000 fine
- Minimum prison sentence of two years
For a second or subsequent offense, the penalties increase:
- $100,000 fine
- Minimum four years in prison

The state has determined that landowners have a duty to destroy any marijuana plants they discover growing on their land, and failure to do so can result in the heavy taxation of your property.
